Please review the terms, rules, and conditions governing your use of the Image MCP Server platform, API endpoints, and agent integration tools.

1. Acceptance of Terms
By accessing or using the services provided by imagemcpserver.com ("Image MCP Server", "Platform", "We", "Us", or "Our"), including our website, Model Context Protocol (MCP) server endpoints, REST API, CLI authentication tool, and credit system, you ("User", "Developer", or "Customer") agree to be bound by these Terms of Service.
If you are agreeing to these terms on behalf of a company, organization, or legal entity, you represent and warrant that you have full authority to bind that entity to this legally binding agreement.
2. Services Provided & MCP Tool Usage
Image MCP Server provides single-protocol image processing and generative AI capabilities built specifically for AI agents, LLM tool calling pipelines, and developer workflows.
Available tools and features include but are not limited to:
- generate_image: Text-to-image synthesis using high-fidelity generative models.
- edit_image & inpainting: Region-based editing, object removal, and style transfer.
- remove_background & transparent_image: AI-powered object isolating and alpha transparency export.
- upscale_image: Resolution enhancement and super-resolution upscaling up to 4K.
- text_to_svg: Scalable vector graphics creation for icons and illustrations.
- multicall: Parallel multi-prompt batch execution for agent workflows.
We reserve the right to add, update, optimize, or deprecate specific backend AI model engines or API endpoints to ensure system quality and security.
3. Account Registration & API Key Security
To access our API and MCP server, you must authenticate via OAuth 2.0 or CLI token authentication. You are solely responsible for maintaining the confidentiality of your account credentials, secret API keys, and authorization headers.
Security Guidelines for Developers:
- Never commit your secret API key to public GitHub repositories or client-side web bundles.
- Store keys securely in environment variables (
IMAGE_MCP_API_KEY). - Immediately regenerate your API key in the Dashboard if you suspect it has been compromised.
Image MCP Server is not liable for any credit losses, unauthorized API consumption, or data exposure resulting from compromised user API keys.
4. Billing, Subscription Plans & Credit System
Our service operates on a credit-deduction pricing model. Every API or MCP tool execution deducts credits based on computational intensity:

Subscriptions & Credit Top-ups: Subscription plans (Free, Pro, Scale) bill monthly and allocate monthly credits. Credit Packs (e.g., $10 for 500 credits) do not expire.
Refund Policy: Payments are processed via PCI-compliant payment partners (e.g., Dodo Payments). Unused credit packs are eligible for a refund within 14 days of purchase if fewer than 5% of purchased credits have been consumed.
5. Intellectual Property & Generation Ownership
User Output Ownership: As between you and Image MCP Server, to the extent permitted by law, you own all rights, title, and interest in and to the output images, SVGs, and processed assets generated using your prompts and input media.
Platform License: You grant Image MCP Server a worldwide, non-exclusive, royalty-free license to store, process, cache, and transmit your input prompts and images solely to fulfill your requests, perform service improvements, and maintain system security.
No Model Training on Private Data: We do NOT sell your input data or generated images to third parties, nor do we use your private API inputs to train public foundational AI models without your explicit opt-in consent.
6. Acceptable Use Policy & Prohibited Acts
You agree not to use Image MCP Server for any illegal or restricted activities, including:
Violations will result in immediate API key revocation, account termination, and potential reporting to relevant law enforcement agencies.
7. Service Availability, SLAs & Rate Limits
While we strive for 99.9% uptime across all MCP server endpoints and backend GPU cluster workers, services are provided on an "as is" and "as available" basis.
Rate Limiting: Standard tier accounts are subject to concurrency limits (e.g., max 60 requests/minute). If your agent script exceeds these thresholds, endpoints will respond with HTTP Status 429 Too Many Requests. Enterprise tiers include dedicated throughput capacity.
8. Limitation of Liability & Warranties
To the maximum extent permitted by applicable law, Image MCP Server and its officers, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or operational disruption.
In no event shall our total aggregate liability for all claims related to the service exceed the total amount paid by you to Image MCP Server during the 12 months preceding the claim.
9. Account Suspension & Termination
You may close your account at any time via your Dashboard settings. We reserve the right to suspend or terminate account access immediately if you breach these terms or engage in fraudulent activities.
